One of my clients is currently attempting to relocate to her home state of Florida, with her children. The parties were divorced in New York and her ex-husband is objecting to the move. The following year she was re-married to a new husband and granted custody of the children. My client wanted to move back to her home state, but included in the divorce was a stipulation that she would either need the consent of her ex-husband, or an order to relocate from the court in order to move with her children. I was able to get the court to grant my client a hearing for relocation. This is a significant step for my client to finally be able to relocate with her new husband and her children and to not be constrained by her ex-husband.
