Calculating Child Support in Long Island

Understanding How Child Support Is Calculated in New York

The state of New York uses a particular formula to calculate child support in divorce cases. First, it must be decided which parent has child custody and who will be the supportive parent. Once these areas have been agreed upon, either through mediation or by a matrimonial law judge, the amount of child support can be calculated.

The court uses the following basic formula to determine the amount of child support:

  • 1 Child 17%
  • 2 Children 25%
  • 3 Children 29%
  • 4 Children 31%
  • 5 or More Children 35%

If you are looking to receive child support, or if you need to ensure that you are not required to pay more than is fair, speak with a Long Island divorce attorney today. Having a skilled attorney by your side can guarantee that the amount of income is correctly calculated and that a fair support judgment is entered. Child support is determined based on the parent's gross income (up to $136,000 per annum) minus Medicare, FICA, and tax deductions, which must be properly calculated in order to avoid a child support order for too much or too little.

Support for Medical Expenses, Child Care & Education

The monthly support paid by supportive parents may be increased beyond the basic award to cover additional expenses for medical care, child care, and education. Both the custodial and noncustodial parent may be required to cover monthly medical insurance for the child, as well as any out-of-pocket medical expenses. The non-custodial parent may be required to pay an additional amount for childcare if the custodial parent is working and/or in school. Both parents may also be required to pay for the child's education, if applicable.

The Importance of Hiring a Divorce Lawyer

Attempting to obtain a fair child support order without the representation of an experienced lawyer is not likely to have the best results. Only an attorney will have the knowledge and experience in the courtroom to present a strong case and ensure that child support is properly calculated.
