The state of New York uses a particular formula to calculate child support in divorce cases. First, it must be decided which parent has child custody and who will be the supportive parent. Once these areas have been agreed upon, either through mediation or by a matrimonial law judge, the amount of child support can be calculated.
The court uses the following basic formula to determine the amount of child support:
- 1 Child 17%
- 2 Children 25%
- 3 Children 29%
- 4 Children 31%
- 5 or More Children 35%

The non-custodial parent may be required to pay an additional amount for childcare if the custodial parent is working and/or in school. Both parents may also be required to pay for the child's education, if applicable.
