The state of New York uses a particular formula to calculate child support in divorce cases. First, it must be decided which parent has child custody and who will be the supportive parent. The court uses the following basic formula to determine the amount of child support:

• 1 Child 17%
• 2 Children 25%
• 3 Children 29%
• 4 Children 31%
• 5 or More Children 35%
